Kurt Weber/Chris Kliesmet I have received a second request for public records requesting copies of certain documents to be sent to Chris Kliesmet in Milwaukee, Wisconsin. As I understand Oregon Statute, the school district has a reasonable period of time to respond to the request, may charge a reasonable fee for time spent locating and copying the record and if the fee is more than $25.00, must provide written notice of the fee(s) and have the requestor confirm the request for records. The specific request in this case is: * All records that were emailed or electronically sent from or received by you or any of your officers, employees, or agents during the period starting from July 3, 2006, to the present which mention or pertain to the Oregon Rainy Day Amendment, TABOR, taxpayers’ bill of rights, Initiative Petition #6, or Measure 48 petition drive. * All records that were emailed or electronically sent from or received by you or any of your officers, employees, or agents during the period starting from July 3, 2006, to the present which mention or pertain to the Term Limits, Initiative Petition #39, or Measure 45 petition drive. The district considered your request under ORS 192.440(4) to furnish copies at no charge or a reduced fee. This waiver is not in the public interest in the sense that the district has not found “making the record available primarily benefits the public.” The district has also considered the financial hardship to the district; the extent of time and expense required to make the search; and the extent to which the materials only meet the particular needs of the requestor. (See, Attorney General Public Records Manual, (2005) page 10.) In response to this request, I have asked staff to prepare a reasonable estimate of districts costs. These follow: A reasonable review-it-all-without-qualification estimate would be: $60 cost per hour of overtime for confidential or administrative employee (needed because of confidential records) There are approx. 450,000 emails in the system; conservatively estimating that 10% of these have attachments, then there are 45,000 attached documents. 1 minute per email to retrieve and open. 3 minutes per email to read and sort 2 minutes per attachment to read and sort Documents Minutes/Doc Total Minutes 60 Min/hr Overtime for Manpower Total 450000 4 1800000 45000 2 90000 1890000 31500 60 $1,890,000.00 These numbers show that it will take over 31,000 hours to review all emails in the system. I am forwarding this cost estimate for review and confirmation of the original records request. I am also informing you that payment must be received before copies of the records, if any exist, will be released.
